To Advance Cooperation on Sustainable Consumption and Production (SCP)

The appointment of advisory representatives in Thailand under the cooperation framework of Sustainism is established for the purpose of strengthening collaboration in sustainable economic development, enhancing organizational capabilities, and accelerating the transition toward transparent, traceable, and responsibly growing economic systems. The initiative is intended to support the expansion of partnership networks, the development of knowledge and capacity-building initiatives, and the implementation of projects related to Sustainable Consumption and Production (SCP), including the promotion of Sustainable Procurement, Responsible Sourcing, ESG, and Sustainable Supply Chains that can be meaningfully connected with the business sector, financial sector, investment community, and stakeholders within sustainable economic systems at both national and Asia-Pacific regional levels.

Such appointment is intended to establish a robust cooperation mechanism for advancing sustainable economic development, supporting organizational readiness during sustainability transition periods, promoting standardized ESG and SCP disclosures, and facilitating effective linkages among buyers, suppliers, investors, and business networks committed to the development of sustainable and traceable supply chain ecosystems.

Scope and Operational Framework

The appointed representatives may undertake activities related to the promotion of Sustainable Consumption and Production (SCP) and sustainable supply chain cooperation under the governance framework and guidance of Sustainism on a strict compliance basis. Such activities may include business advisory services, financial and investment advisory, sustainability strategy development, sustainability reporting, support for Sustainable Procurement initiatives, and the implementation of activities reflecting SCP, ESG, and Responsible Sourcing dimensions in alignment with principles of good governance and internationally recognized standards.

All representatives shall conduct their activities under principles of transparency, accountability, and voluntary cooperation. Such status shall not be interpreted, represented, or communicated in any manner that may imply formal certification, endorsement, appointment, or official approval by the United Nations, governmental authorities, or regulatory bodies, unless expressly authorized in writing through specific documentary authorization.

Comprehensive Disclaimer, Limitation of Authority, and Limitation of Liability

For the purpose of this disclaimer, the term “Sustainism Initiatives” shall collectively refer to all projects, mechanisms, platforms, activities, recognition pathways, cooperation frameworks, directories, events, publications, documents, communications, advisory coordination, and any other operations established, operated, supported, coordinated, or referenced by Sustainism, whether currently existing or to be developed in the future, including but not limited to sustainability-related initiatives, Sustainable Consumption and Production (SCP) initiatives, supplier and buyer readiness mechanisms, recognition programs, capacity-building activities, sustainability disclosure support pathways, business-sector capability development, and collaborative platforms.

Sustainism Initiatives are voluntary cooperation mechanisms established solely for the purpose of supporting sustainability-related development approaches, business-sector capacity enhancement, knowledge exchange, disclosure practices, cooperation mechanisms, and the promotion of responsible business practices. Sustainism Initiatives do not constitute, and shall not be interpreted as constituting, a statutory regulatory authority, certification body, ESG rating agency, professional licensing authority, audit authority, investment accreditation body, governmental entity, United Nations entity, or formal representative of any international organization, unless explicitly stated otherwise in writing.

Participation in, application to, appointment under, recognition within, listing on any platform, participation in activities, receipt of documents, submission of information, payment of fees, acceptance of services, or any other action associated with Sustainism Initiatives shall not constitute automatic certification, guarantee, standards accreditation, ESG rating endorsement, legal approval, financial endorsement, investment accreditation, tax approval, procurement approval, market access guarantee, business benefit assurance, or any form of official approval.

No participant, company, representative, coordinator, advisor, applicant, service recipient, partner, supporter, or any other person or entity associated with Sustainism Initiatives shall use such participation, status, listing, document, recognition, or relationship for solicitation, advertising, fundraising, investment promotion, offering, sales representation, business representation, commercial claims, or any communication that may create the impression that Sustainism or Sustainism Initiatives have been officially endorsed, sponsored, hosted, operated, guaranteed, certified, recognized, or formally affiliated with the United Nations, United Nations agencies, governments, regulatory authorities, capital markets, investors, financial institutions, certification bodies, or international organizations, unless expressly authorized in writing by Sustainism.

All companies, representatives, coordinators, advisors, applicants, participants, service recipients, partners, supporters, and any persons or entities associated with Sustainism Initiatives expressly acknowledge and agree that representatives, coordinators, and advisors act solely in the capacity of advisors, coordinators, facilitators, or operational support persons, within the scope assigned to them. They shall not be deemed legal representatives, authorized agents, partners, joint venture partners, brokers, investment representatives, certification representatives, sales agents, or official representatives of Sustainism, whether expressly or impliedly, unless specifically authorized in writing.

Representatives, coordinators, advisors, partners, and associated persons shall have no authority to execute agreements, bind Sustainism, certify outcomes, issue standards accreditations, provide ESG ratings, issue official certificates, provide guarantees, assure benefits, confirm procurement opportunities, represent investment outcomes, collect fees, or undertake any act on behalf of Sustainism unless specifically authorized in writing.

All representatives, coordinators, advisors, partners, participants, and associated persons shall refrain from using any wording, insignia, logos, marks, institutional names, project names, platform names, photographs, documents, event references, venue references, or communications that may create misunderstanding among the public, investors, consumers, regulators, business partners, media, or third parties that any company, person, project, activity, or initiative has received endorsement, guarantee, certification, approval, standards accreditation, or formal affiliation with the United Nations, any United Nations agency, government, regulatory authority, investor, capital market, certification body, or international organization.

Any request to use any emblem, logo, mark, project name, platform name, or intellectual property relating to Sustainism and Sustainism Initiatives must be submitted in writing through the Secretariat at secretariat@stnsm.org only. Such use shall be permitted only after written approval has been granted by Sustainism. The granting of status, participation in any project, partnership, receipt of documents, listing on any platform, or participation in any activity shall not automatically create any right to use Sustainism’s emblems, logos, marks, project names, platform names, or intellectual property.

Sustainism reserves the right to determine the conditions, format, duration, scope, purpose, channels of use, and communication guidelines relating to the use of all emblems, logos, marks, project names, platform names, or intellectual property. Sustainism shall have the right to suspend, revoke, or require the immediate cessation of such use if such use does not comply with the approved conditions, creates misunderstanding, affects reputation, or may cause third parties to believe that a person or entity has received endorsement, guarantee, representation, or formal affiliation beyond what Sustainism has authorized.

The foregoing restrictions include, without limitation, the use of false or misleading information, exaggerated communications, unauthorized use of symbols or marks, unauthorized reference to institutional names, misleading references to events or venues, claims of guaranteed business outcomes, claims of official certification, claims of investment readiness or approval, or the collection of fees, benefits, commissions, or other consideration without prior written authorization from Sustainism.

All publicity materials, proposal documents, presentations, social media content, website content, business cards, email signatures, announcements, sales materials, media communications, and any other public or internal communications relating to Sustainism Initiatives shall be submitted to Sustainism for prior review and approval before publication or circulation, where such materials refer to Sustainism, its projects, platforms, recognition mechanisms, events, partners, logos, emblems, or any related status.

In the event that Sustainism determines that any conduct, communication, representation, publication, claim, or activity is misleading, inconsistent with good faith principles, legally risky, reputationally harmful, lacking transparency, damaging to credibility, inconsistent with the objectives of Sustainism Initiatives, or otherwise detrimental to the legal integrity or public trust of Sustainism, Sustainism reserves the absolute right to temporarily suspend status, revoke recognition, remove names from platforms, suspend publication, refuse participation, terminate cooperation, issue public clarifications, disclaim association, notify relevant persons or organizations, or undertake any other measures deemed appropriate without prior notice.

Sustainism, including its founders, executives, representatives, coordinators, advisors, partners, supporters, affiliated entities, and related persons, shall not be liable, whether directly or indirectly, contractually, commercially, tortiously, or otherwise, for any damages, losses, investments, loss of profits, loss of opportunities, business disputes, contractual disputes, reputational damages, regulatory issues, business decisions, interpretations of information, use of information, reliance upon status, operational conduct of representatives, third-party actions, unauthorized communications, or any impacts arising from or relating to participation in, operation of, use of services under, publication of information relating to, communications regarding, or utilization of Sustainism Initiatives.

Such limitation of liability shall apply whether the relevant matter arises from actions, omissions, misunderstandings, misinterpretations, third-party interpretations, data inaccuracies, incomplete information, unauthorized representations, reliance on public materials, changes in project direction, force majeure events, regulatory developments, market conditions, or circumstances beyond the reasonable control of Sustainism.

All participants, applicants, companies, representatives, coordinators, advisors, partners, supporters, service recipients, and associated persons expressly agree that they shall remain solely responsible for their own operations, decisions, claims, communications, legal compliance, financial decisions, business conduct, use of information, reliance on any documents or materials, and any resulting consequences arising from their own activities, in accordance with applicable laws, contractual obligations, ethical standards, transparency requirements, and principles of good faith business conduct.

The submission of documents, provision of information, payment of fees, electronic acceptance, written acceptance, participation in activities, use of project names, listing on platforms, receipt of documents, utilization of services, attendance at events, or engagement in any activities relating to Sustainism Initiatives shall constitute full acknowledgment, acceptance, and binding agreement to all terms, disclaimers, conditions, limitations of authority, and limitations of liability contained herein in their entirety.
